Terms of Service

Effective November 4, 2026 · Version 2026-11-04-vendors

These Terms of Service are an agreement between you and James M. Franklin Jr., an individual currently operating the Navtaps service (referred to as "Navtaps," "we," "us," or "our"). Navtaps lets businesses and other organizations manage destinations associated with NFC tags and QR codes, create redirect links and hosted pages, and make certain files available online. By creating an account or using Navtaps, you agree to these terms. If you do not agree, do not use the service.

Navtaps is currently operated by an individual and is not yet operated by a separate limited liability company. If a business entity later becomes the provider, the contracting-party information and these terms will be updated, and users will be notified as appropriate.

1. Your account

You must be at least 18 years old to create an account. If you create or manage an account for a business, ministry, or other organization, you represent that you are authorized to act for that organization and to accept these terms on its behalf. You are responsible for providing accurate information and keeping your email address current.

Keep your login credentials confidential. You are responsible for activity through your account, except to the extent applicable law provides otherwise. Notify us promptly if you believe your account has been accessed without authorization.

2. Acceptable use

Navtaps is intended for legitimate organizational uses, including sharing information about your business, products, online store, payment links, events, and documents. You may not use Navtaps to link to, upload, or distribute content that is illegal; facilitates unlawful activity; deceives people through phishing, scams, fake login or payment pages, or impersonation; contains malware or harmful downloads; sexually exploits or harms children; threatens, harasses, or promotes violence; infringes another person's rights; sends spam; or contains confidential, sensitive, or unlawfully obtained information.

You may not interfere with, overload, reverse engineer, or circumvent the security or technical limits of Navtaps, or use the service to conceal a destination in a deceptive or harmful manner. Navtaps is not designed or guaranteed as an emergency alert, emergency communications, life-safety, or mission-critical system. Do not rely on it as the sole means of communicating emergency instructions or other time-critical safety information.

3. Link checks, moderation, and suspension

Navtaps may check links when they are saved and when they are tapped, using Google's Web Risk service. Link screening is an additional security measure; it is not a guarantee that every harmful, fraudulent, malicious, or inappropriate destination will be detected. You remain responsible for checking the links and destinations you publish.

We may remove content, block or disable a link, restrict access to a file or page, or suspend or terminate an account when we reasonably believe action is necessary to enforce these terms, respond to a report, protect users or third parties, protect the platform or its infrastructure, or comply with law. We may act without advance notice when urgent circumstances require it. When reasonably practical, we will provide an explanation and an opportunity to correct the issue.

To report a link, file, page, or account that may be misused, email navtapssupport@gmail.com.

4. Your content and uploaded files

You retain ownership of the links, names, files, images, text, and other content you submit, subject to rights held by others. You grant Navtaps a limited, non-exclusive license to host, store, reproduce, transmit, display, and otherwise use that content only as reasonably necessary to operate, maintain, secure, support, and provide the service, including delivering files and pages to people who access your tags, QR codes, and links.

You are responsible for your content and represent that you have all rights and permissions needed to submit and make it available through Navtaps. You must not upload or publish content that violates these terms or applicable law. Supported uploads are PDF, JPG, and PNG files, subject to the file-size and other technical limits shown in the service.

Everything you publish through Navtaps is public. Content published through Navtaps is intended to be accessible to people who have or obtain the relevant link, scan the QR code, tap the NFC tag, or otherwise reach the published page. Tags and QR codes can be photographed, copied, forwarded, or shared. Navtaps is not a confidential document-storage service or a private file-sharing system. Do not publish passwords, door or alarm codes, private Wi-Fi credentials, personal records, customer, member or visitor lists, prayer requests, children's identifying details, health or counseling information, financial account information, or other information that should not be publicly accessible. For private information, link to a secure system where people must log in. You are solely responsible for any private information you choose to publish.

You are responsible for maintaining independent backup copies of your files and information. We do not guarantee permanent storage, preservation, or recovery of content. Files may become unavailable or be deleted due to technical problems, maintenance, account changes, enforcement actions, or termination of the service.

5. Plans, billing, and beta access

Navtaps is in a free beta. We do not currently collect any payment. During the beta, we may provide free access, temporary upgrades, promotional access, or additional features at no charge. Beta access and promotional upgrades may be changed, suspended, or discontinued, and any end date or conditions we communicate for a temporary upgrade will apply. Beta access does not create a promise of continued free service. We will never charge you or move your account to a paid plan unless you choose one. Before paid plans start, we will update these terms and give account owners at least 30 days' notice.

The Free plan is provided at no charge. Paid plans, if and when offered, will be described in the service and may be billed monthly or annually in advance through a third-party payment processor. Paid subscriptions renew automatically until cancelled. Cancellation takes effect at the end of the paid period unless applicable law requires otherwise. Refunds for partial billing periods are not provided except where required by law or expressly stated by us.

We will provide at least 30 days' notice before a price change applies to an existing paid subscription, unless a different period is required by law. If an account is downgraded, features such as schedules or editing capacity may be limited according to the plan description. Tags and QR codes keep working after a downgrade, but tap cards over the new plan's limit may become locked for editing. We will explain applicable plan limits in the service.

6. Tags, QR codes, and destinations

Each NFC tag or QR code uses an associated Navtaps address. Once a physical tag has been programmed or a QR code has been printed or distributed, its underlying Navtaps address generally cannot be changed without replacing or reprogramming the tag or replacing the QR code. The destination associated with that address may be changed through the Navtaps account, subject to the user's plan and available features.

You are responsible for purchasing, programming, placing, testing, and maintaining your physical tags and QR codes, and for verifying the destination associated with each one before distributing or relying on it. You are also responsible for the accuracy, legality, and suitability of content on third-party websites to which you link.

A destination change may affect people attempting to use the associated tag, QR code, or link. We do not control third-party websites and are not responsible for their content, availability, security, or practices.

Payment buttons. Buttons for Cash App, Venmo, PayPal, Square or other payment services only link to your own account with that service. Navtaps does not process, hold, receive, refund or see those payments. Every sale and payment is between you, your customer and that payment service, under its terms. You are responsible for your sales, taxes, refunds, and for making sure your payment links point to your own account.

7. Availability, changes, and third-party services

We work to keep Navtaps available, but we do not guarantee uninterrupted, timely, secure, or error-free operation. Navtaps depends on third-party hosting, storage, authentication, email, security, network, and other providers, including Cloudflare and Supabase. Service may be affected by outages, maintenance, internet or telecommunications failures, cyberattacks, provider changes, or other events beyond our reasonable control.

Redirects, schedules, uploaded files, and pages may be delayed, unavailable, or fail to operate as expected. Changes may take time to propagate and may not appear immediately on every device, browser, network, NFC reader, or QR code reader. We may modify, add, limit, or discontinue features. Keep independent copies of important files and do not use Navtaps as the sole means of delivering critical information.

8. Privacy

Our Privacy Policy explains how information is collected, used, stored, and shared in connection with Navtaps. The Privacy Policy is incorporated into these terms by reference. If you have questions or privacy requests, contact navtapssupport@gmail.com.

9. Ending or suspending service

You may stop using Navtaps at any time. To request account closure and deletion of eligible account information, email navtapssupport@gmail.com. We may suspend or terminate access as described in Section 3, or discontinue the service with at least 30 days' notice where reasonably practical. We may act sooner when required for security, legal compliance, or other urgent reasons.

When an account is closed, suspended, or terminated, associated tags, QR codes, redirects, hosted pages, and files may be disabled or become unavailable. On downgrade, tags continue to work while editing or scheduling features may be restricted, as described in the applicable plan. Before closing an account, download any content you want to keep. Information may remain temporarily in backups or records retained for security, legal, or legitimate business purposes.

10. Beta software and experimental features

You acknowledge that Navtaps or certain features may be provided in beta, pre-release, or experimental form. Beta software may contain bugs, defects, errors, interruptions, security vulnerabilities, or incomplete functionality. Features may be changed, restricted, suspended, or discontinued, and beta data may not be preserved.

You voluntarily choose to use beta software and are responsible for evaluating whether it is appropriate for your needs. Maintain independent copies of important information and verify your tags, QR codes, destinations, schedules, and hosted content. Do not rely on beta features as the sole means of providing emergency communications, safety instructions, critical business information, or other time-sensitive information.

11. Disclaimers and limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NAVTAPS IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.

TO THE FULLEST EXTENT PERMITTED BY LAW, NAVTAPS AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DONATIONS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF NAVTAPS AND ITS OPERATOR FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NAVTAPS FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50.

These exclusions and limits apply only to the extent permitted by applicable law. They do not limit liability that cannot legally be excluded or limited. Some jurisdictions do not allow certain warranty disclaimers or damage limitations, so some provisions may not apply to you.

12. Your responsibility to us (indemnification)

To the extent permitted by law, you agree to indemnify and hold harmless Navtaps and its operator from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from your content, your misuse of the service, your violation of these terms, or your violation of another person's rights or applicable law. This obligation does not apply to the extent a claim results from the negligence, willful misconduct, or violation of law by the party seeking indemnification. The procedures and scope of this provision are subject to applicable law.

14. Events beyond our reasonable control

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, governmental actions, power failures, internet or telecommunications disruptions, cyberattacks, third-party infrastructure failures, labor disputes, or similar events.

15. Changes to these terms

We may update these terms as the service changes. For material changes, we will post the revised terms, update the effective date, and provide notice to account owners by email or through the service before the changes take effect where reasonably practical. If you do not agree to revised terms, stop using Navtaps. Continued use after the effective date constitutes acceptance to the extent permitted by law.

16. Governing law, venue, and general terms

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal action arising out of or relating to these terms or Navtaps must be brought in the state or federal courts located in Hillsborough County, Florida, subject to applicable jurisdictional and venue requirements.

These terms and the Privacy Policy constitute the agreement between you and Navtaps concerning the service and supersede prior agreements on that subject. If any provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver. You may not transfer your account or rights under these terms without our consent. We may transfer these terms in connection with a business reorganization, asset transfer, or successor operation, subject to applicable law.
